Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the MyScribe platform at myscribe.dev (“Service”), operated by MyScribe. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use MyScribe. By using the Service you represent that you meet this requirement and that any information you provide is accurate and complete. Coaches using CGM or clinical health data features represent that they hold appropriate professional qualifications for their jurisdiction.
2. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorised use at [email protected].
- You may not share your account or create accounts on behalf of others without their consent.
3. Acceptable Use
You agree not to:
- Use the Service to transmit unlawful, harmful, harassing, or defamatory content.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Reverse-engineer, decompile, or attempt to extract the source of the Service.
- Use automated tools to scrape or bulk-download content without written permission.
- Resell or sublicense access to the Service without prior written agreement.
- Violate any applicable laws or the terms of any third-party service connected to your account.
- Use the SMS or voice communication features to send unsolicited messages or in violation of TCPA or applicable telecommunications law.
4. SMS Messaging Program
MyScribe operates an SMS messaging program (“MyScribe Coaching SMS”) through which coaches communicate with their clients via text message.
Opt-in: By providing your mobile phone number and completing checkout on myscribe.dev, you expressly consent to receive SMS messages from your enrolled coach(es) through the MyScribe platform. The consent checkbox at checkout reads: “I agree to receive SMS messages from my coach via MyScribe. Message & data rates may apply. Reply STOP to opt out.” The same consent step appears on coach invite landing pages. Checkout and invite acceptance cannot be completed without this consent.
Prospects who call a coach’s line may separately consent to receive a single follow-up SMS via IVR keypress. This consent is captured with a recording of the consent audio, IP address, and timestamp.
- Program name: MyScribe Coaching SMS
- Message types: Coaching responses, check-in reminders, scheduling notifications, service alerts, and re-engagement messages.
- Message frequency: Varies based on your coaching program. Typically 1–10 messages per week per enrolled coach.
- Message and data rates may apply. Check with your mobile carrier for details.
- To opt out: Reply STOP to any SMS at any time. You will receive one confirmation and no further messages will be sent.
- To re-enable: Reply START to the same number.
- For help: Reply HELP or contact [email protected].
- Supported carriers: Major US carriers including AT&T, T-Mobile, and Verizon. Carrier support not guaranteed for all MVNOs.

5. Call Recording & Voice Communications
Telephone calls between active subscribers and their coaches are recorded for coaching continuity and knowledge-base development. A compliance message plays at the start of every recorded call: “This call may be recorded and transcribed for coaching purposes.” Continuation of the call constitutes your consent to recording. The consent event is stored with a timestamp.
Calls are transcribed using Twilio Conversational Intelligence or OpenAI Whisper. Only coach utterances are eligible for knowledge-base candidate generation; client utterances are used for coaching context only and are never published to the knowledge base. Recordings and transcripts are stored per coach tenant and are not shared cross-tenant.
Outbound calls from coaches to prospects (non-subscribers) are not recorded.
Coach responsibility: Coaches are solely responsible for compliance with all applicable call recording laws in their jurisdiction, including any state or local consent requirements beyond those disclosed here.
6. Wearable & Health Data
MyScribe supports voluntary integration with wearable devices and health platforms including Apple HealthKit, Fitbit, Oura Ring, Garmin Connect, Whoop, Dexcom G6/G7, Libre 3 (Abbott), and Withings. By connecting a device you agree to the following:
- Client-initiated only: Your coach cannot initiate a wearable connection. You must explicitly authorise the connection and select which data categories to share.
- Explicit consent: At connection time you provide explicit, versioned, scope-documented consent. The consent record captures the exact categories shared, a hash of the consent text, timestamp, IP address, and user agent.
- Coach data access: Your coach sees trend summaries and aggregated views by default. Your coach cannot access any category you have not enabled.
- Disconnection: You may disconnect a device at any time from your account settings. Disconnection initiates a 90-day grace period before permanent purge. Explicit deletion requests are processed within 30 days.
- Data portability: Request a CSV export of your wearable data at any time by contacting [email protected].
- Provider terms: Connecting a wearable platform also subjects that connection to the wearable provider’s own terms and privacy policy.
7. Health & Medical Disclaimer
MyScribe is a coaching platform, not a medical device. Nothing on the platform constitutes medical advice, diagnosis, or treatment.
Wearable health data, glucose readings, and any coaching content delivered through the platform are provided for coaching context and personal wellness awareness only. This information should not be used to make clinical decisions, adjust medications, or replace the advice of a licensed healthcare provider.
MyScribe does not operate as Software as a Medical Device (SaMD) under FDA guidelines. The platform is a coaching intelligence layer — it connects existing health data to existing coaching relationships. Coaches using MyScribe represent that they operate within the scope of their own qualifications and applicable professional regulations.
Clients with medical conditions — including but not limited to diabetes, metabolic disorders, or cardiovascular conditions — should consult a licensed healthcare provider before acting on any coaching guidance informed by wearable data.
CGM-based threshold alerts delivered through the platform (including hypoglycaemia notifications) are informational signals for coaching awareness only. They are not a substitute for the CGM device’s own clinical alert system or emergency medical care. If you experience a medical emergency, call emergency services immediately.
To the fullest extent permitted by law, MyScribe disclaims all liability for health outcomes arising from the use of wearable data or coaching content delivered through the platform.
8. AI Features & Limitations
MyScribe uses artificial intelligence to power several platform features. The following limitations and rules apply:
- Coach-authored responses only: All client-facing coaching responses are authored or approved by your human coach. The AI layer retrieves and routes pre-approved coach answers to known questions. New questions that cannot be matched from the knowledge base are escalated directly to the coach for personal reply. AI does not independently generate responses that are delivered to clients.
- Knowledge-base integrity: AI-generated knowledge-base candidates (from Brain Dump, call transcripts, or document processing) require explicit coach review and approval before entering the knowledge base. No AI-generated content becomes part of the knowledge base without coach consent.
- Limitations: AI-assisted features may produce errors, omissions, or outdated suggestions. Coaches are responsible for reviewing all AI-generated content before use.
- OpenAI: Certain features use the OpenAI API. Content submitted via the API is not used to train OpenAI models per their API terms.
9. Bookings
MyScribe provides scheduling tools for coaches to manage appointments with clients. By using the bookings feature:
- Appointment availability is set by the coach and is subject to change.
- Booking confirmation is sent by email and/or SMS where consent exists.
- Cancellation and rescheduling policies are set by individual coaches. Review your coach’s policies before booking.
- MyScribe is not responsible for disputes arising from appointment cancellations, no-shows, or scheduling errors caused by the coach or client.
10. Agency Accounts & Consultant Access
Agency accounts allow an agency operator to manage a team of coaches or consultants. The following rules apply:
- Agency supervisors may access knowledge-base candidates and escalation queues submitted by their consultants for quality review and governance.
- Consultants operate under the supervision of the agency and must comply with these Terms.
- Client coaching data remains scoped to the individual coaching relationship. Agency supervisors do not have access to private client coaching threads or personal health data without explicit client consent.
- Agency operators are responsible for ensuring their consultants’ compliance with applicable laws, including TCPA, GDPR, and applicable professional regulations.
- Cross-tenant data access is strictly prohibited.
11. Subscriptions & Billing
MyScribe offers free and paid subscription tiers. Paid plans are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except where required by law. We reserve the right to change pricing with at least 30 days’ notice. Client coaching subscription payments are processed between clients and coaches via Stripe Connect; platform fees apply per the published fee schedule.
12. Your Content
You retain ownership of all content you create or upload to MyScribe. By using the Service, you grant us a limited, non-exclusive licence to store, process, and display your content solely as necessary to provide the Service. We will not use your content to train AI models without your explicit consent. Coach-authored knowledge-base content is your intellectual property and is not shared with other coaches or tenants.
13. Intellectual Property
The MyScribe platform, including its design, software, and branding, is owned by or licensed to us and protected by intellectual property laws. Nothing in these Terms transfers any of our intellectual property rights to you.
14. Third-Party Integrations
MyScribe integrates with third-party services including Instagram, TikTok, YouTube, Stripe, OpenAI, Twilio, Apple HealthKit, Fitbit, Oura Ring, Garmin Connect, Whoop, Dexcom, Libre (Abbott), Withings, and Cloudflare. Your use of those integrations is also subject to the respective third-party terms and privacy policies. We are not responsible for the availability, conduct, or data practices of third-party services.
15. Termination
You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that harms other users or the integrity of the Service. Upon termination, your data is retained for the periods described in our Privacy Policy before permanent deletion.
16. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free. AI-assisted coaching features are tools to support human coaches and should not be relied upon as independent professional advice. Health and wearable data features are for coaching context only — see Section 7 for the full health disclaimer.
17. Limitation of Liability
To the fullest extent permitted by law, MyScribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to health outcomes arising from coaching guidance, wearable data interpretation, or AI-assisted features. Our total liability shall not exceed the greater of the amount you paid us in the preceding 12 months or $100.
18. Governing Law
These Terms are governed by the laws of the jurisdiction in which MyScribe is registered. Any disputes shall be resolved in the courts of that jurisdiction.
19. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Continued use after the effective data constitutes acceptance.
